Terms of Use

These Terms of Use govern your use of Noctly (the "App"), developed and operated by David Martos ("I", "me", "we"). By downloading or using Noctly, you agree to these terms.

1. The service

Noctly is an iOS application for recording and exploring dream journals. The app offers a free tier and a Noctly Pro subscription that unlocks additional features. Features and pricing are subject to change with reasonable notice.

2. Subscriptions and billing

Noctly Pro is available as a monthly or annual subscription. All billing is handled by Apple through the App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID settings under Subscriptions.

Prices are displayed in the App Store in your local currency. I reserve the right to change prices; you will be notified before any price change takes effect for your existing subscription.

3. Acceptable use

You agree to use Noctly only for its intended purpose — personal dream journaling. You may not:

• Attempt to reverse engineer, decompile, or tamper with the App
• Use the App for any unlawful purpose
• Share your account or subscription with others
• Attempt to extract or scrape App content by automated means

4. Your content

All dream journal entries you create belong to you. Noctly does not claim ownership over your content. Your data is stored on your device and in your personal iCloud account and is not accessible to me. See the Privacy Policy for full details.

5. Disclaimer of warranties

Noctly is provided "as is" without warranties of any kind, express or implied. Dream interpretations generated by the App are for entertainment and self-reflection purposes only. They are not psychological, medical, or therapeutic advice. Do not make important decisions based solely on dream interpretations.

6. Limitation of liability

To the maximum extent permitted by applicable law, David Martos shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Noctly. This includes but is not limited to data loss, service interruption, or personal harm. My total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.

7. Termination

You may stop using Noctly at any time by deleting the App. I reserve the right to suspend or terminate access if these Terms are violated, though I will always try to resolve issues constructively first.

8. Changes to these terms

I may update these Terms from time to time. I will update the effective date above and notify you within the App when changes are material. Continued use of Noctly after changes constitutes acceptance of the updated Terms.

9. Governing law

These Terms are governed by the laws of Spain, without regard to conflict of law principles.
